An employee under an indefinite contract can only be terminated due to performance-related reasons or redundancy. Fixed-term contracts in Kiribati are terminated as soon as they expire. Employers must give the reason for termination in writing before the last date of employment.

According to the Labour Law, upon termination, the employer must provide compensation based on mutual agreement or payment in lieu of notice.
The Kiribati work permit is granted to applicants who meet certain requirements and submit the necessary documents. The foreigner must be between the ages of 20 and 45 and have a medical certificate proving their good health. Some applicants shall submit a character certificate with a clean police record.
The employer must submit the relevant documents in the Ministry of Foreign Affairs and Immigration. The Ministry also grants temporary/permanent residency visas to foreign employees.
