Employee severance and terminations in Austria

For a service period of fewer than 24 months, an employee must serve a statutory notice period of 6 months. An employee who has served for 3-5 years is entitled to 2 months’ notice, which increases to 5 months’ notice for those who have served for over 26 years.

Severance pay is also mandatory in Austria. Any employee serving the employer over a month is eligible for 1.53% of their month’s salary to be deposited to an employee provision fund. On termination, the employee can keep this amount in their fund or draw it as severance pay.
